Member: Any person or organization that holds an active account. Network: The interconnection set up to transport data. Registration: The process of registration on our website, but before acceptance. Roaming: The service which allows the usage of a service on other operators' networks, usually in foreign countries. SIM: A physical or digital item that carries your phone number set up to grant access to the network. Suspension: The temporary disconnection of a service. Provision of Service
We will take all reasonable steps to make all services continuously available. However, please be aware that,
• The quality and availability of a service may sometimes be affected by factors outside our control. This includes but is not limited to
• Local or temporary physical obstructions
• Atmospheric conditions
• Other causes of radio interference or
• Faults in other networks to which the network is connected.
• The quality of a service may not be at its best inside buildings or below ground.
• A service may sometimes be affected by maintenance and upgrading.
• From time to time, upgrades, modifications, or maintenance are required to the network or service. Such requirements may result in some or all services becoming temporarily unavailable. We will do everything possible to keep any unavailability to a minimum. Nevertheless, some interruptions may be inevitable.
• Since roaming depends on the liability of foreign networks, we cannot offer any warranties, express or implied, concerning the quality of any roaming service.
• Some SMS may be delivered delayed or even not delivered at all. This is out of our control, and we won't refund any charges in that case.
• If we have a reason to believe that a member is in breach of one or more terms of our contract, we may decide to suspend some or all services for the member without prior notice.
• Although we strive to keep charges and rates consistent and always as low as possible for our members, those charges and rates are subject to change at any time and without prior notice.
• CosmoSIM cards are designed to work within the countries where pricing is published on our website.
Members should be familiar with the list of countries where pricing is published and should only use their CosmoSIM in countries where pricing is published.
In the event that a CosmoSIM is used in a country where no prices are published, the member is responsible for payment of these services, and funds for the services will be deducted from the member's account.
Termination (End of Service)
Members can terminate any service within their account at any time. Any deposit balance in the account at the time of termination will not be refunded.
Refunds
All products and services on this website are refundable, excluding vouchers or trail and testing amounts.
Ownership of Phone Numbers
Members cannot claim ownership of any phone number assigned to their CosmoSIM. In case of termination of a CosmoSIM for any reason, any phone number may be revoked and re-assigned immediately to another member.
You agree that we will not be liable for damages (including consequential or special) that may arise from such procedures.
In this context, you waive any claims concerning any such procedures, no matter if they are based on contractual, tort, or other grounds.
You further understand and agree that we may be forced to change any phone number assigned to any CosmoSIM.
This may result, for instance, from an area code split or any other reason out of our control.
However, in such unlikely events, we will contact you to discuss the best solution for your case.
Misuse of Service
Members are not authorized to charge services provided by us to a third party or to request or otherwise cause any third-party service provider to charge any such services to a service provided by us.
Any such attempt will result in the immediate termination of the member's account without further notice.
Fair Usage Agreement (Unlimited Data Package)
We reserve the right to discontinue Unlimited Data Package services to any member who significantly exceeds our network's average monthly data usage.
Unlimited Data Package must be used only by a single mobile device and for regular and reasonable use like emailing, web browsing, or GPS navigation.
Unlimited Data Package must not be used for Wi-Fi router distribution or peer-to-peer connections.
In general, usage of more than 4000 MB of data per Unlimited Data Package may be considered a fair usage violation and result in discontinuation of the service.
In such an event, we will not refund the Unlimited Data Package.
